A Somalia-born man is set to appear before Melbourne Magistrates Court today (18 November, 2025) charged with allegedly failing to comply with his visa-mandated conditions.
The AFP charged the man, 44, on 18 November, 2025, after he was located in Melbourne, Victoria.
It will be alleged the man breached one of the conditions of his Commonwealth visa by failing to maintain his Electronic Monitoring Device.
The man has been charged with:
- One count of fail to maintain Electronic Monitoring Device, pursuant to section 76D of the Migration Act 1958 (Cth). This offence carries a maximum penalty of five years' imprisonment and/or a $99,000 fine.
- One count of intentionally damage property belonging to Commonwealth entity, pursuant to section 132.8A of the Criminal Code (Cth). This offence carries a maximum penalty of imprisonment for 10 years; and
- Four counts of possession of personal property reasonably suspected of being stolen pursuant to section 26 of the Summary Offences Act 1966 (Vic). This offence carries a maximum penalty of imprisonment for one year.
