A Sudan-born man appeared before the Melbourne Magistrates Court today (21 May, 2025), charged with allegedly failing to comply with his visa-mandated conditions.
The AFP arrested and charged the man, 38, today, after locating him in Melbourne.
It will be alleged he breached the conditions of his Commonwealth visa 15 times between 3 May, 2025, and 20 May, 2025.
The man has been charged with:
Five counts of failing to ensure electronic monitoring device remains in good working order, contrary to section 76D(3) of the Migration Act 1958 (Cth); and
10 counts of failing to remain at a notified address, contrary to section 76C(1) of the Migration Act 1958 (Cth).
These offences carry a maximum penalty of five years' imprisonment and a $93,900 fine.
He was also charged with one count of committing an indictable offence while on bail, contrary to section 30B of the Bail Act 1977 (Vic). This offence carries a maximum penalty of three months' imprisonment and a fine of $5,927.
