A Sudan-born man is set to appear before the Melbourne Magistrates' Court today (19 August, 2025), charged with allegedly failing to comply with his visa-mandated conditions.
The AFP arrested and charged the man, 32, today after locating him in Melbourne.
It will be alleged he breached the conditions of his Commonwealth visa between 5 August, 2025, and 16 August, 2025.
The man has been charged with:
- Two counts of failing to ensure electronic monitoring device remains in good working order, contrary to section 76D(3) of the Migration Act 1958 (Cth);
- Four counts of failing to comply with visa curfew conditions, contrary to section 76C (1) of the Migration Act 1958 (Cth);
- Six counts of committing indictable offences whilst on bail, contrary to section 30B of the Bail Act 1977 (Vic); and
- Six counts of contravening a conduct condition of bail, contrary to section 49F of the Summary Offences Act 1966 (Vic).
The maximum penalty for each offence is five years' imprisonment and/or a $99,000 fine.
