An Eritrea-born man is set to appear before Melbourne Magistrates Court today (20 November, 2025) charged with allegedly failing to comply with his visa-mandated conditions.
The AFP charged the man, 38, on 20 November, 2025, after he was located in Melbourne.
It will be alleged the man breached one of the conditions of his Commonwealth visa by failing to maintain his electronic monitoring device.
When AFP officers arrested him, they allegedly found him in possession of a flick knife and a driver's licence in another person's name.
The man has been charged with:
One count of fail to maintain an electronic monitoring device, contrary to section 76D of the Migration Act 1958 (Cth). This offence carries a maximum penalty of five years' imprisonment and/or a $99,000 fine;
One count of possess a prohibited weapon, pursuant to section 5aa of the Control of Weapons Act 1990 (Vic). The maximum penalty for this offence is two years' imprisonment and/or a $48,842 fine; and
One count of handling stolen goods, pursuant to section 88 of the Crimes Act 1958 (Vic). This offence carries a maximum penalty of 15 years' imprisonment.
