Ex-NDIS Provider Director Faces Dishonesty Charges

Byson James Kete Turner of Western Australia has been charged with dishonestly using his position as a director and failing to comply with a requirement to appear for an examination with ASIC.

At the time of the alleged offences, Mr Turner (also known as Byson James Kete Attrill-Green) was the director of Links Support and Consulting Services Pty Ltd which operated as an unregistered provider of services under the National Disability Insurance Scheme (NDIS).

Following an ASIC investigation, it Is alleged that between 4 September 2019 and 18 July 2022, Mr Turner used his position as a director of Links to unlawfully make 2,782 separate transfers totalling $858,948 from Links to the following accounts in his name:

  • Sportsbet
  • Apple
  • TABTouch
  • NetLotto
  • LottoGo
  • Lotterywest
  • Oz Lotto and
  • Plus500AU.

It is also alleged on 10 May 2024 and 30 May 2024, Mr Turner failed to comply with a requirement made under the ASIC Act to attend two separate ASIC examinations when compelled to do so.

Mr Turner appeared in the Perth Magistrates Court on 6 February 2026. The matter has been adjourned for further mention on 17 April 2026.

The matter is being prosecuted by the Office of the Director of Public Prosecutions (Cth) (CDPP).

The maximum penalty for the alleged offences contrary to s 184(2) of the Corporations Act is 15 years' imprisonment, a fine of 4,500 penalty units or both.

The maximum penalty for the alleged offences contrary to the ASIC Act is two years' imprisonment, a fine of 240 penalty units or both.

Background

Mr Turner has been charged with:

  • eight counts of dishonestly using his position as a director intending to gain an advantage for himself pursuant to s184(2)(a) of the Corporations Act which has a maximum penalty of 4,500 penalty units, or imprisonment for 15 years, or both; and
  • two counts of failing to comply with a requirement made under s19 of the ASIC Act to appear at an ASIC examination which has a maximum penalty of 240 penalty units, or imprisonment for two years, or both.

Links Support and Consulting Services was placed under the control of a liquidator on 14 February 2023.
