Man in Victoria charged over theft and visa breach

A Sudanese-born man is expected to appear in Melbourne Magistrates Court today (6 December, 2023) for allegedly failing to comply with a curfew and allegedly stealing luggage at Melbourne Airport.

The AFP arrested and charged the man, 45, earlier today after locating him at a Melbourne hotel.

It will be alleged the man breached conditions of his Commonwealth visa on 1 December, 2023, by failing to observe his residential curfew obligations. It is also alleged the man went to Melbourne Airport, where he stole luggage from a traveller who was asleep in the terminal.

The man has been charged with:

  • One count of theft, contrary to section 74 of the Crimes Act 1958 (Vic) as applied by section 4 of the Commonwealth Places (Applications of Laws) Act 1970 (Cth). This offence carries a maximum penalty of 10 years' imprisonment; and
  • One count of fail to comply with a curfew condition, contrary to section 76C(1) of the Migration Act 1958 (Cth). This offence carries a maximum penalty of 5 years' imprisonment and a $93,900 fine.
