SAFEGUARDING NEW YORK CITY'S ESSENTIAL SERVICES
WHEREAS, the City of New York is entrusted with the continuous delivery of essential services upon which all New Yorkers depend, including public safety, health, transportation, water, education, social services, the administration of justice, and communication of critical information to the public; and
WHEREAS, the continuity of these essential services is foundational to the safety, welfare, and economic vitality of all New Yorkers, and must be sustained regardless of the nature, scale, or duration of any disruption; and
WHEREAS, effective continuity of essential services requires the integration of Continuity of Operations ("COOP"), Continuity of Government ("COG"), and Mission Assurance across all City agencies, coordinated at the most senior levels of City government; and
WHEREAS, sustained coordination among City agencies, including those responsible for emergency management, technology, and physical assets, is essential to maintaining continuity readiness before, during, and after disruptions; and
WHEREAS, Executive Order No. 107, issued October 2, 2007, established the City's initial framework for Continuity of Operations planning, and while that Order advanced important foundational work, the intervening years have demonstrated the need for a more comprehensive and updated policy to address evolving threats; and
WHEREAS, it is the policy of this Administration to ensure that City agencies institute plans to maintain the delivery of essential services to all New Yorkers without interruption during any emergency, disruption, or threat thereof; and
WHEREAS, to advance this policy, the City shall establish and sustain a coordinated, proactive, and comprehensive framework for continuity planning, risk monitoring, and operational readiness across all City agencies;
NOW, THEREFORE, by the power vested in me as the Mayor of the City of New York, it is hereby ordered:
Section 1. Definitions. For the purposes of this Order, the following terms have the following meanings:
a. "Citywide Priority Essential Services" means those essential services identified through an interagency process whose disruption would produce the most significant cascading impacts for New Yorkers and for the functioning of City government.
b. "Continuity of Operations" ("COOP") means the ability of a City agency to maintain or rapidly resume its essential services during and after a disruption to normal operations.
c. "Continuity of Government" ("COG") means the preservation of the constitutional and lawful authority and leadership of City government, including lines of succession, delegations of authority, and the safeguarding of vital records during and after a disruption.
d. "Mission Assurance" means the proactive and continuous process of identifying, managing, and mitigating risks to the City's ability to deliver essential services, encompassing planning, monitoring, coordination, and resource alignment across all phases of a disruption.
§ 2. Continuity and Mission Assurance Team. There is hereby established a Continuity and Mission Assurance Team ("CMAT"), which shall serve as the City's senior interagency body for COOP, COG and mission assurance policy, planning, coordination, and oversight. The CMAT shall:
a. Be chaired by the Deputy Mayor for Operations, or their designee. The Chair shall be responsible for setting the strategic direction of the City's continuity and mission assurance programs, convening the CMAT, and ensuring continuity priorities are reflected in citywide policy, resource allocation, and performance management.
b. Be composed of senior representatives of New York City Emergency Management ("NYCEM"), the Department of Citywide Administrative Services ("DCAS"), the Office of Management and Budget ("OMB"), and the Office of Technology and Innovation ("OTI"), and any additional agency or office as determined by the Chair. Each representative shall have sufficient authority within their respective agency or office to commit resources, share information, and make or elevate policy and operational decisions.
i. NYCEM shall serve as the lead coordinating agency for the City's continuity and mission assurance programs. NYCEM shall be responsible for developing and maintaining citywide continuity policies, standards, and guidance; administering the City's enterprise continuity planning software; supporting priority interagency readiness activities as designated by the CMAT; and staffing and supporting the operations of the CMAT.
ii. DCAS shall provide functional leadership and subject matter expertise to the CMAT for facilities, fleet, logistics, and personnel continuity.
iii. OMB shall serve as an advisory partner to ensure that continuity planning and readiness are reflected in the City's fiscal, capital, and performance management processes.
iv. OTI shall provide functional leadership and subject matter expertise to the CMAT for information technology, cybersecurity, and communications continuity.
v. The Chair may direct additional agencies and offices to participate or support specific CMAT initiatives, working groups, or coordination activities as necessary.
c. Meet on a regular basis, no less than quarterly, and more frequently as conditions require.
§ 3. Agency Responsibilities and Coordination.
a. Mayoral agencies shall:
i. Identify essential services and ensure that such services reflect any significant functional or operational changes to the agency over time.
ii. Maintain a COOP, updated and exercised no less than once annually, that addresses both the continuity of the agency's essential services and its role in sustaining the continuity of City government. Such plans shall be consistent with citywide standards and guidance issued pursuant to this Order and shall be updated annually by December 31st of each calendar year.
iii. Designate a senior official responsible for continuity planning and readiness within such agency, to serve as the Executive Sponsor of the agency's COOP, and to coordinate the agency team responsible for the development and maintenance of the agency's COOP.
b. The Deputy Mayor for Operations and NYCEM shall take all steps necessary, consistent with applicable law, to facilitate and encourage participation by non-mayoral City agencies and other entities affiliated with the City in the initiatives set forth in this Order.
§ 4. Citywide Priority Essential Services. NYCEM, in coordination with the CMAT, shall establish and maintain a framework for identifying Citywide Priority Essential Services, which shall receive heightened attention in planning and monitoring. The CMAT shall periodically review and update the identification of such services to reflect evolving risks and City priorities.
§ 5. Accountability and Reporting. Each agency shall maintain and annually update a COOP plan consistent with citywide continuity planning standards. Each agency also will conduct at least one exercise annually to test its COOP plan. The CMAT, acting through NYCEM, shall be responsible for enforcing agency compliance of both the annual COOP plan update and the required annual exercise, and shall report on agency compliance as CMAT determines appropriate.
§ 6. Executive Order No. 107, dated October 2, 2007, is hereby REVOKED.
§ 7. This order shall take effect immediately.
