ASIC has permanently banned New South Wales based investment manager, Brett Paul Trevillian, from providing financial services and engaging in credit activities following his conviction for serious fraud.
The conviction related to Mr Trevillian creating and distributing forged performance verification reports which were used to solicit investments from clients of AlphaThorn Pty Ltd.
Under the Corporations Act 2001 (Cth) and the National Consumer Credit Protection Act 2009 (Cth), ASIC may permanently ban a person from providing financial and credit services if they are convicted of serious fraud, which includes offences involving dishonesty.
Mr Trevillian has also been permanently banned from:
- controlling an entity that carries on a financial services business
- performing any function involved in the carrying on of a financial services business, and
- engaging, controlling or performing any function involved in credit activities.
The banning took effect from 18 August 2025.
Mr Trevillian's banning has been recorded on the banned and disqualified register.
Background
Mr Trevillian was the sole director and secretary of Metal Alpha Pty Ltd and acted as investment manager for AlphaThorn Pty Ltd.
On 20 December 2024, Mr Trevillian was convicted of two counts of making a false document to obtain a financial advantage under s253 of the Crimes Act 1900 (NSW) and sentenced to three years imprisonment, to be served by way of an intensive correction order (24-249MR).
