Griffin Coal convicted of breaching financial reporting and company officer obligations

The Griffin Coal Mining Company Pty Limited (ACN 008 667 285) has been convicted of failing to meet its financial reporting obligations and failing to have the required number of company directors residing in Australia.

The conviction follows an ASIC investigation that found that Griffin Coal failed to lodge annual reports with ASIC for its financial years ended 31 March 2018, 31 March 2019, 31 March 2020 and 31 March 2021 within the required timeframes and failed to meet the legal requirement to have at least one director who resides in Australia between 28 September 2018 and 6 December 2021.

Griffin Coal was sentenced in the Perth Magistrates Court on 1 July 2022 and fined $4,000.00.

The matter was prosecuted by the Commonwealth Director of Public Prosecutions.

Background

Griffin Coal was first charged in June 2021 for failing to lodge four annual financial reports in the time frame required (refer 22-067MR).
