The updated Shoalhaven Local Approvals Policy (LAP) comes into effect this month after it was endorsed by Council.
The policy outlines the activities that require approval from Council in accordance with Section 68 of the NSW Local Government Act 1993, including:
- Footpath dining
- Street stalls
- Water supply
- Installation of sewerage management systems
- Drainage
- Installation of caravans/manufactured homes
- Operation of mobile food vans.
The policy also establishes exemptions for certain activities that do not require approvals, and the criteria needed to seek an approval or an exemption.
A local approval is different to a development consent issued under the NSW Environmental Planning and Assessment Act 1979 and may be required on its own or in addition to a development consent.
The LAP was adopted by Council at the Ordinary Meeting on 12 August. Part one of the policy has also received approval from the NSW Department of Planning, Housing and Infrastructure and the NSW Office of Local Government.
