Transitional R-Codes Arrangements To Conclude In April

Special transitional arrangements introduced in 2024 under Western Australia's R-Codes Volume 1 will conclude as planned on 10 April 2026.

The temporary provisions were introduced to give stakeholders time to adjust local planning frameworks and development practices in line with the updated R-Codes Volume 1, which guide residential planning and design across the state.

Extensive consultation with the R-Codes Stakeholder Advisory Group led by WA Planning Commission (WAPC) Deputy Chair Ray Haeren, which includes representation from peak industry bodies, professional associations and local government, has confirmed broad readiness across industry for the transitional period to end.

However, while the initial 24 month transitional period was expected to be sufficient for subdivision and titling processes, delays in servicing and approvals mean some lots will be unable to meet the deemed to comply solar orientation requirement in Clause 2.2.4 (Part C) once the transitional arrangements end.

To ensure timely housing delivery and prevent unnecessary development applications and imposts on local governments, a targeted administrative amendment has been approved. The amendment:

  • Takes effect 10 April 2026 and remains in place until 10 April 2030.
  • Applies only to single houses in R50 and above areas identified in structure plans or local development plans approved before 10 April 2024.
  • Exempts these dwellings from the deemed-to-comply solar orientation requirement (Clause 2.2.4, Part C).

From 10 April 2026:

Transitional provisions will no longer apply.

  • Single houses in areas coded R50 and above subject to a structure plan or local development plan must be assessed against Part C of the R-Codes Volume
    • 1. Exception: Clause C2.2.4 Solar Orientation will remain exempt until 10 April 2030 for single houses within R50 and above areas approved prior to 10 April 2024.
  • Single house and grouped dwelling developments must be assessed against Design Element 3.1 - Site Cover, with transitional deemed-to-comply provisions in Part C, Section 5 no longer applicable.
  • Local planning frameworks that modify provisions within the R-Codes Volume 1 must be updated and approved by 10 April 2026, otherwise the R-Codes Volume 1 provisions will prevail.
