Court decision in animal welfare case welcomed

  • Court rules WA animal welfare laws are not inconsistent with Commonwealth laws with regards to live animal export 
  • Agriculture and Food Minister Alannah MacTiernan has welcomed a decision in the Magistrates Court of Western Australia that WA's Animal Welfare Act is not inconsistent with Commonwealth laws in relation to live animal exports.

    The decision was handed down in the ongoing Department of Primary Industries and Regional Development prosecution of Emanuel Exports Pty Ltd.

    The decision supports the State Government's position that WA's animal welfare laws can be applied to live animal exports without necessarily conflicting with Commonwealth law.

    As stated by Agriculture and Food Minister Alannah MacTiernan:

    "Today's ruling provides clarity on a long-contested point in our animal welfare laws.

    "This clarification is important for both industry and government in understanding our responsibilities in relation to welfare on board live export ships."
