A planning proposal, draft Development Control Plan (DCP) amendments and a draft Voluntary Planning Agreement (VPA) with respect to land at 48 Terry Road, Box Hill are currently on public exhibition.
The planning proposal seeks to make the following amendments to State Environmental Planning Policy (Precincts – Central River City) 2021:
- Rezone the eastern portion of the site at 48 Terry Road, Box Hill from SP2 Infrastructure to R3 Medium Density Residential;
- Introduce a maximum building height of 14m for the proposed R3 zoned land;
- Introduce a minimum density of 18 dwellings per hectare for the proposed R3 zoned land;
- Introduce a maximum density of 42 dwellings per hectare with a new local provision clause for the proposed R3 zoned land; and
- Remove the eastern portion of the site from the Land Reservation Acquisition Map.
The planning proposal would enable a medium density housing product comprising a maximum of approximately 121 dwellings.
Draft amendments to The Box Hill and Box Hill Industrial Development Control Plan 2018 have been prepared in association with the planning proposal to guide built form outcomes on the site. The changes will amend Figures 2, 3, and 14 to identity the subject site as 'Medium Density Residential' and include a new local road on the northern boundary of the site.
A draft VPA is concurrently on exhibition, which would ensure the rezoning of this land for residential development does not result in an unfunded infrastructure burden on Council and the community. The VPA would comprise capital works and land dedication for the future half width road on the northern boundary of the site. The VPA would also require the dedication of land along Terry Road frontage of the site to facilitate road widening and the upgrade of Terry Road. The VPA would not exclude future development from the payment of full monetary contributions under the Contributions Plan No. 15 – Box Hill, which will be calculated as normal at the time of any future development consent.
The planning proposal is the result of advice from School Infrastructure NSW (SINSW) to the landowner and Council that the NSW Government will no longer be acquiring this parcel of land for the purpose of a school, as identified in the Precinct Planning for the Box Hill Precinct. Despite Council's objections to Government, SINSW will now only be acquiring the 2 adjoining properties to the north (at 50 and 52 Terry Road) rather than all 3 properties at 48-52 Terry Road as originally planned.
The Government has recently completed the construction of a new temporary school on George Street to service Box Hill residents and is progressing with the design of a permanent school at 50-52 Terry Road, with construction estimated to be completed in 2028.
A Gateway Determination for the planning proposal was issued on 7 August 2024. Delegation has been issued to Council as the Plan Making Authority under the Gateway Determination.
