Fed Sheds Court Proceedings Resolved

The Land and Environment Court recently resolved the Fed Sheds matter which will see a Development Application for 467 Federal Drive, Federal, go ahead subject to various consent conditions.

The consent conditions require the applicant to build stormwater infrastructure on adjoining land as a precondition to development of the Fed Sheds site.

The development application includes demolition of existing structures on the site, removal of vegetation and construction of three buildings to be used for the purposes of light industry, excluding artisan food and drink premises. It includes 21 car parking spaces.

The development application was refused by Council in December 2022 for various reasons including the lack of stormwater infrastructure.

The applicant started merit review proceedings against Council in the Land and Environment Court in February 2023.

As part of the Court's conciliation process, Council and the applicant agreed to an amended form of the original development.

The Land and Environment Court was satisfied the agreed development could be approved by the Court and concluded the matter. The Court is yet to publish its judgment.
