In important cases before the Court of Justice of the European Union (ECJ) in Luxembourg, judgments are preceded by an opinion of an advocate-general. These opinions are not binding on the Court, but are highly influential in practice.
Following the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the EU, the book "Shaping EU Law the British Way: UK Advocates General at the Court of Justice of the European Union" examines the influence of the UK Advocates General on the case law of the Court of Justice. This topic is of particular interest because British law, as a so-called "common law system", differs from continental European law. In her contribution to this volume, Tobler, professor of European Law discusses Advocate General Warner's opinion in the landmark case of Bouchereau on the issue of restricting the free movement of persons on public policy grounds in the case of persons with previous criminal convictions.
