Victorian director sentenced for making false statement to ASIC

Timothy Lee Knight of Ivanhoe East, Victoria, has been convicted after pleading guilty to authorising the making of a false or misleading statement to ASIC, contrary to s1308(2) of the Corporations Act.

Mr Knight was formerly the director of Knight & Day Eating Pty Ltd (ACN 611 316 333) (deregistered) (KDE) which operated a restaurant business.

On 16 May 2019, on his authorisation, a Form 6010 was lodged with ASIC to voluntarily deregister KDE, declaring that the company did not have any outstanding liabilities when, at the time, Mr Knight was aware that KDE had an outstanding debt of $225,293.00 to Knight & Day Property Painting Pty Ltd (ACN 162 632 760) (in liquidation), another company of which Mr Knight was also the sole director.

Mr Knight was convicted and fined $1,500 following his guilty plea on 17 August 2022 at Heidelberg Magistrates' Court.

The matter was prosecuted by the Commonwealth Director of Public Prosecutions following a referral from ASIC.
