Department fines company for breaching environmental approval conditions

The Department of Agriculture, Water and the Environment has fined a construction company for failing to meet environmental approval conditions.

On 24 September 2020 the department issued two infringement notices totalling $26,640 to Narre Warren Central Pty Ltd for not meeting several conditions attached to their approval received under Part 9 of the Environment Protection and Biodiversity Conservation Act 1999.

The approval was granted on 5 February 2016 to undertake a residential development on Centre Road, Narre Warren, Victoria (EPBC 2014/7380) with 13 conditions attached.

The company failed to meet conditions 3, 9 and 11 of the approval.

Condition 3 requires water quality to be maintained for the duration of the project for the protection of the threatened species Dwarf Galaxias, condition 9 requires notification of commencement, and condition 11 requires preparation and publication of annual compliance reports.

The department takes non-compliance with approval conditions seriously. This penalty serves as a reminder that approval holders must comply with their approval conditions.
